Regular Meeting Minutes

President James Soriano called the Village Council to order at 6:00pm

Pledge to the flag was recited

Roll call: Evelyn Jones-present, James Soriano-present, Kathryn Kerr-present, Michelle Kundrat-present

Public Comment: A resident is concerned about her neighbor’s long grass actions will be taken, a resident asked about the trucks from the school demolition going down Norman St. Tom will speak with the Foreman, a resident asked about debris by his house from DPW, Tom will clean it up.

James Soriano made a motion seconded by Kathryn Kerr to appoint Lavonne Cowan to the open Trustee seat, roll call-James Soriano-yes, Michelle Kundrat-no, Kathryn Kerr-yes, Evelyn Jones-no, motion fails

James Soriano made a motion seconded by Evelyn Jones to appoint Steven Hammond to the open Trustee seat, roll call-Kathryn Kerr-no, Michelle Kundrat-yes, James Soriano-yes, Evelyn Jones-yes, motion passes

Steven Hammond was sworn in as a Trustee

Barryton Police Report: Chief Morgan read the Police report

It is recommended by Chief Morgan to mail all blight letters by Certified mail 

Evelyn Jones made a motion seconded by James Soriano to Have DPW Director take over Ordinance Officer at a pay rate of $500 annually, roll call-all yeses, motion passes

DPW Report: Tom Brown read the report-DPW Dept has been working at the lagoons, mowing, fixing drains, fixing pot holes, and made a new flower bed under the Farmers Market sign. Brian Sutton will be fixing the drains at Angel and Renwick and Park Place and Hudnut. Tom will be using Evelyn Jones’s flat bottom boat for Sludge Judge, Tom will be setting up an appointment with Secretary of State to get plates for the new trailer and the one we currently own that has never had a plate.

Evelyn Jones made a motion seconded by Kathryn Kerr to allow Shelly Lee to put sod over her sidewalk, roll call-all ayes, motion passes

Minutes of Regular Meeting June 9, 2021, and Special Meeting Minutes June 28, 2021, were presented

Kathryn Kerr made a motion seconded by Michelle Kundrat to accept all minutes as written, all ayes, motion passes

Melissa Lazzaro read the Clerks Report: Melissa presented Council with information on the Annual MML Meeting, asked about the progress on getting flags up on M66, Council needs to decide how many flags they want, they will work on it. The new truck and trailer have been added to the insurance, Melissa is working on the Recreational Marijuana applications,  insurance audit and ARPA Application, she asked about  checks being left out instead of locked in the file cabinet after they are signed, a previous Council member lost their key to the filing cabinet, they will be locked from now on, received title for trailer, Melissa will not be cleaning the meeting room anymore, Melissa checked with the County and was told we can make the East River Park any address we want, Tom will check on addresses on Coolidge,  Melissa has had several residents ask about all the weeds in town, Tom said he’s working on them, the new regulatory signs were ordered and will be shipped on 7/15/2021, the slide was ordered and will be delivered in August, dump truck has been posted in Pioneer, in boards, and on Facebook, informed Council Kathryn can no longer scan minutes without purchasing the program, it was decided to use new copy machine to scan to the external hard drive, reminded Tom about the Pavilion Rental on the 17th that would like power, and brought up the possibility of in the future having a mural drawn on a building in the Village

Courtney Garchow read the Treasurer’s Report: Bank Balances are unavailable at the time due to not receiving a statement as of meeting day, Courtney will get it from the bank.

Still waiting to hear information on refinancing the sewer loan, the Village will have to apply for special circumstances since tax delinquencies are so high, Farmers Market check has cleared and has been confirmed paid in full, will be posting a sign about cash payments, the Office does not have change for cash payments, residents must have the correct change or the extra amount will be applied to your account, she is still working on biannual audit, Courtney will not seek out Audit Committee members that leave notes on bills, if you have a questions-do more, call Courtney, Melissa, or another Council member, Courtney will be on vacation from July 24-August 1.

Evelyn Jones made a motion seconded by Kathryn Kerr to pay General Fund bills with check #18637-18675 and 272& 273(E) for $7,292.08, Sewer Fund with check # 3292-3296 for $2,701.13, Motor Pool fund with check #1337-1348 for $37,374.04, Local Street Fund with check #1008 for $115.74, Major Street Fund with check #1083 for $ 1,768.46 and Solid Waste Fund with check #779 for $2,160.60 for a total of $51,412.05, roll call-all yeses, motion passes

The Village received a card from a tourist complimenting the bunting at Central Park and thanked the Village for its Patriotism, an email was sent to the Village letting us know about a resident with a drone that is willing to take pictures for the Village, and a letter from someone at DHD #10 asking about tobacco in our parks.

Quotes were presented for the Farmers Market parking lot and the walking trail, it was determined that it is not in this year’s budget. 

The New Treasurer was not able to return to Michigan early, she is scheduled to start with the Village August 3, 2021, if she is unable to start, Council will move on to another applicant.

Council has decided to wait until next year to do the Tree Grants, so we have more time to plan for it.

Kathryn Kerr read the proposed changes to these Ordinances: Consumers Energy, Ordinance #9-2015 Reduction or Elimination of Blight, Ordinance #1-2015 Elected Council Compensation, Remove Clerk/Treasurer, Medical Marijuana Ordinance, Recreational Marijuana Ordinance

A Public Hearing is scheduled for July 21, 2021, with a Special Meeting immediately following  

Kathryn Kerr made a motion seconded by Evelyn Jones to publish the Public Hearing in the Pioneer, roll call-all yeses, motion passes

Kathryn Kerr made a motion seconded by Evelyn Jones to refund $100 to Chris Carley for pre-paid Farmers Market booth, roll call-all yeses, motion passes

Kathryn Kerr made a motion seconded by Michelle Kundrat to make Chris Carley the new Market Manager, roll call-all ayes, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to hire Kathrine DeVary as the new Treasurer, on a 30 day trial period at training wages of $12.00/hr. Courtney will train at current wage, if needed after training period Courtney will be paid $15.00/hr. to continue to train, roll call-all yeses, motion passes

Evelyn Jones made a motion seconded by James Soriano to accept the Labor Board Recommendation for the DPW Pay Scale to be capped at $18.00/hr. to start in March 2022, roll call-James Soriano-yes, Kathryn Kerr-yes,  Steven Hammond-yes, Michelle Kundrat-no, Evelyn Jones-yes, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to give Tom Brown a $1.00/hr. raise effective in August until March of 2022 when the new DPW pay scale starts, roll call-Michelle Kundrat-no, Kathryn Kerr-yes, Steven Hammond-yes, James Soriano-yes, Evelyn Jones-yes, motion passes

Evelyn Jones made a motion for the Clerk and current Treasurer to each receive an 8% raise which equals out to $1,040 each per year covered by licensing fees, roll call-Steven Hammond-yes, James Soriano-yes, Michelle Kundrat-no, Kathryn Kerr-yes, Evelyn Jones-no, motion passes

Melissa Lazzaro read the Resolution allowing the number of licenses issued for the Medical Marijuana Ordinance and the Recreational Marijuana Ordinance to increase within the Village of Barryton

Evelyn Jones made a motion seconded by Michelle Kundrat to extend the meeting by 10 minutes, roll call-all ayes, motion passes

Evelyn Jones made a motion seconded by Michelle Kundrat to approve Vivid Farms LLC Recreational Class B Grow Application, roll call-all ayes, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to approve M66 Group LLC Recreational Class B Application, roll call-all ayes, motion passes

James Soriano made a motion seconded by Kathryn Kerr to make Evelyn Jones the third check signer and to add her to signature cards for all Village accounts, roll call-all ayes, motion passes

Kathryn Kerr made a motion seconded by Evelyn Jones to accept the land split from Steven Huffman to his Brother Mark Huffman, roll call-all ayes, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to renew the membership with Michigan Rural Water Association for $360 for the year, roll call-all yeses, motion passes
