Regular Meeting Minutes

President James Soriano called the Village Council to order at 6:00pm

Pledge to the flag was recited

Roll call: Evelyn Jones-present, James Soriano-present, Kathryn Kerr-present, Michelle Kundrat-present, Steven Hammond-present

Public Comment: A resident brought up concerns about selling Village land at too low of a price, claiming that James Soriano is working for the M66 Group, taking Agricultural off the zoning for growing facilities. The resident then left the meeting. President James Soriano allowed public comment/discussion to go on until 7:30 pm.

Barryton Police Report: Chief Morgan read the report

DPW Report: Tom Brown read the report-DPW Department has been cleaning up the brush at East River Park and at the Village Office, they started picking up leaves on October 1st and will continue through November 15th, the new salt spreader is here and ready to go, Central Park bathrooms will be closing the end of October and the port a johns in Central and East River Parks will be picked up October 29, 2021. Al from Main-Tech is looking into replacing pump parts and or pumps. Tom is requesting new lights and light bulbs for the barn, and is asking the Village to purchase him a safety jacket for winter.

Evelyn Jones made a motion seconded by Kathryn Kerr to purchase 2 hanging lights for the barn, not to exceed $60.00, roll call-all yeses, motion passes

Evelyn Jones made a motion seconded by Michelle Kundrat to purchase 6 LED light bulbs for the barn, not to exceed $75.00, roll call-all yeses, motion passes

James Soriano made a motion seconded by Kathryn Kerr to purchase 200 sewer flags not to exceed $38.00, roll call-all yeses, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to purchase 2 winter Safety Jackets not to exceed $90.00 plus shipping, not to be worn outside of work hours and are property of the Village, roll call-all yeses, motion passes

Minutes of Regular Meeting September 8, 2021, and Special Meeting Minutes September 15, 2021, were presented

Evelyn Jones made a motion seconded by Steven Hammond to accept all minutes as written, roll call- all ayes, motion passes

James Soriano read the President report, he has been working with Tom on Project Wednesday clearing the river banks at East River Park and behind the Village Office, he is happy with Project Wednesday as it’s helping to see things happen in the Village.

Melissa Lazzaro read the Clerks Report: Melissa is working on finding all the signed ordinances, getting them together and figuring out which ones we don’t have, if any. There were a few updates that needed to be taken care of on the ARPA application that has been done and resubmitted, to apply for ARPA I had to open a SIGMA account with the State of Michigan, because of that, we now will receive all checks from the State electronically through SIGMA, she would like to make a new email for Mindy, as she’s not familiar with what emails are hers, that way the Treasurer emails can be forwarded to the Treasurer.

Michelle Kundrat made a motion seconded by Kathryn Kerr to accept the Clerk report, roll call-all ayes, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to extend the meeting until 9:00 pm, roll call-all ayes, motion passes

Mindy Campbell read the Treasurer’s Report: Bank Balances as of 09/30/2021 per Isabella Bank Statement: General Fund: $165,191.32, Sewer Fund: $258,211.86, Solid Waste Fund: $36,279.30 Major Streets Fund: $100,172.27 Local Streets Fund: $41,264.13 Motor Pool Fund: $39,605.56 Sewer Bond Interest $1,018.86.

The Farmer’s Market Master is moving and will not be available next year, Mindy is still working on bank recs, they are not balancing, she will get with Courtney next week to get them finished. Direct Deposit is available to the Village for a $50 monthly fee, the Village could change 1 or more accounts to a Corporate Account and make more interest to offset the monthly charge.

Michelle Kundrat made a motion seconded by James Soriano to offer direct deposit and change General Fund to a Corporate Account, roll call-James Soriano-yes, Evelyn Jones-no, Kathryn Kerr-yes, Michelle Kundrat-yes, Steven Hammond-no, motion passes

Kathryn Kerr made a motion seconded by Evelyn Jones to accept the Treasurers Report as read, roll call-all yeses, motion passes

Evelyn Jones made a motion seconded by Kathryn Kerr to pay General Fund bills with check #18760-18815 and 276(E) for $17,042.42 Sewer Fund with check # 3307-3315 for $7,470.33, Motor Pool fund with check #1352-1358 for $7,516.56, Local Street Fund with check #1012-1020 for $4,333.21, Major Street Fund with check #1087-1088 for $533.73 and Solid Waste Fund with check #783-784 for $3,153.83 for a total of $40,050.08, with $14,119.42 in due to’s and $25,930.66 in bills, roll call-all yeses, motion passes

There was a message left on the Village Office answering machine from a resident stating that oil was dumped in the alley by her home, she asked if Tom could take care of it and also fix the ruts in the alley. Tom will go look at the alley and clean up the oil.

James Soriano made a motion seconded by Evelyn Jones to fill the alley between Darrah and Hudnut with excess dirt from the school, roll call-all ayes, motion passes

Melissa read an email from the MML Attorney handling the Donnie Dennis case.

Tom and Evelyn have not been able to get together to get the information for the flags on M-66 so Melissa Lazzaro and Kathryn Kerr will take over.

Planning Commission is working on the Capital Improvement Plan they are meeting the 1st Wednesday of every month.   

Kathryn Kerr made a motion seconded by Michelle Kundrat to move forward with the process of annexing land into the Village, roll call-all yeses, motion passes

Michelle Kundrat made a motion seconded by Evelyn Jones to extend the meeting until 11:00 pm, roll call-all ayes, motion passes

James Soriano made a motion seconded by Kathryn Kerr to have Eric Williams, the Village’s Attorney, forward the purchase agreement for the land sale to the M-66 Group LLC’s Attorney

James Soriano rescinded the previous motion

Evelyn Jones made a motion seconded by Michelle Kundrat to have Melissa Lazzaro contact Eric Williams to see when he is available to attend a Special Meeting, roll call-all yeses, motion passes

Tom was reminded October is when it’s time to follow the Due Care Plan in Central Park

There are Confined Space classes available for the DPW Department, Melissa Lazzaro will Contact Matt from Michigan Rural Water to see if the Village can hold a meeting at the Village Hall for a reduced rate.

Evelyn Jones made a motion seconded by Michelle Kundrat to set up the WEX Fuel Card, and to leave the Fuel Management card open as well, roll call-all yeses, motion passes

Council would like a drawing from Vivid Farms LLC as to where they would like to place their sign before they approve it.

Council would like to thank Chris Carley and all the vendors and patron for another successful year at the Farmer’s Market.

Council decided to go with the Facebook poll and have Trick or Treating in the Village on Saturday October 30, 2021

James Soriano nominated Kathleen Tucker for the empty seat on the Planning Commission

Michelle Kundrat made a motion seconded by Evelyn Jones to accept the nomination and appoint Kathleen Tucker to the Planning Commission, roll call-all ayes, motion passes

Evelyn Jones made a motion seconded by Steven Hammond to give Rocky Dunklee a .55 raise, he is not to use his cell phone while he is punched in and the handbook procedures will be enforced, to begin when he is medically released from his Doctor, roll call-James Soriano-no, Kathryn Kerr-yes, Steven Hammond-yes, Evelyn Jones-yes, Michelle Kundrat-no, motion passes

Due to there being a quorum when there are more than 2 Council members on a committee, James Soriano has changed all the committees, for a 90 day trial period, all Council members will be given a list of the new committees, any Council member may attend a committee meeting they are not on, but must sit in the audience

Council Comment: Tom Brown will be off on October 18th

Melissa Lazzaro was notified by the family of Steve Mortensen that he passed away earlier that day
