Regular Meeting Minutes

President James Soriano called the Village Council to order at 6:00pm

Pledge to the flag was recited

Roll call: Evelyn Jones-present, James Soriano-present, Kathryn Kerr-present, Michelle Kundrat-present, Steven Hammond-present

Public Comment: Cindy Mason from City Impact Cedar Springs described what she does in Cedar Springs and would like to eventually like to start a group in Barryton, A resident asked about a follow up on ordinance violations, Kathryn Kerr is working with Chief Morgan and Officer Durham and making weekly lists of violations

Barryton Police Report: Chief Morgan was absent

DPW Report: Tom Brown read the report: Toms is requesting weed killer, and hot patch, Barryton Excavating should be here next week to fix the storm drain at Angel and Hudnut and Angel and Renwick, Tom needs a new phone his is not working properly, there are continuing problems at lift station 4 due to inappropriate items being flushed into the sewer system, Tom will be off on July 21, 2022

Evelyn Jones made a motion seconded by Kathryn Kerr to purchase two (2) 2.5-gallon containers of weed killer from Tractor Supply, not to exceed $340, roll call-all yeses, motion passes

James Soriano made a motion seconded by Kathryn Kerr to purchase 4 tons of hot patch for local and major streets, roll call-all yesses, motion passes

Evelyn Jones made a motion seconded by Steve Hammond to send a letter to the residents on the north end of town and on Haddix Blvd to remind them not to flush inappropriate items into the sewer system, roll call-all ayes, motion passes

Minutes of Public Hearing June 13, 2022, Regular Meeting June 13, 2022 and Special Meeting June 20, 2022 were presented

Evelyn Jones made a motion seconded by Kathryn Kerr to order new stickers for the outside of the lift stations with Tom’s phone number on them, not to exceed $144, roll call-all yeses, motion passes

James Soriano read the President Report-James informed Council that the County Commissioners have scheduled a public hearing on the land annexation and encouraged Council to attend if possible, he hasn’t received anything from Fleis & Vandenbrink about the dam inspection yet, received Bridge inspection results, he will be sending Josh from RS Scott an email to give us a quote on the items that need to be repaired that the Village can’t fix, he was approached by a tree trimming company and asked if they could park their trucks in Central Park while working in the area in October.

Evelyn Jones made a motion seconded by Kathryn Kerr to allow the tree trimming company to park in Central Park, not on the asphalt, except the last weekend in October, they will park at the Village barn, for a charge of $300 a month, roll call-all yeses, motion passes

Melissa Lazzaro read the Clerk’s report: Melissa presented Council with a contract with Coyne Oil for propane at the barn at a cost of $1.999.

Evelyn Jones made a motion seconded by Kathryn Kerr to accept the contract with Coyne Oil for propane at a cost of $1.999, roll call-all yeses, motion passes

Kathryn Kerr made a motion seconded by Evelyn Jones to accept the Clerks Report, all ayes, motion passes

Courtney Garchow read the Treasurers report: Bank balances as of 6/30/2022, General Fund-$142,494.73, Sewer Fund-$282.502.48, Solid Waste Fund-$40,214.15, Major Streets-$118,700.02, Local Streets-$47,648.96, Motor Pool-$33,223.33.  Courtney needs the direct deposit form from those who want it, interest will no longer be deposited into the account for General and Sewer Funds-part of the account analysis for direct deposit, tax letters have been mailed with letters enclosed, and we received the final ARPA Payment of $18, 547.95.

Evelyn Jones made a motion seconded by Steven Hammond to accept the Treasurers Report as read, roll call-all yeses, motion passes

Evelyn Jones made a motion seconded by Steven Hammond to pay General Fund bills with check #19144-19184 291-294(E) for $12,673.32, Sewer Fund with check # 3361-3363 3046-3048(E) for $7,784.13, Motor Pool fund with check #1404-1409 16-17(E) for $4,653.75, Solid Waste Fund with check #802 for $264.00, and Major Street with check #0(E) for $1,019.11 for a total of $26,394.31, roll call-all yeses, motion passes

A letter from Paul Bullock was read, about the public hearing scheduled for August 4, 2022 at 11:30 am

An email with a settlement agreement from the case filed by Donnie Dennis was explained by James Soriano

James Soriano made a motion seconded by Steven Hammond to sign the settlement agreement in the Donnie Dennis case, roll call-all yeses, motion passes

Kathryn Kerr will continue to get information on bringing Solar panels to the Village

Kathryn Kerr made a motion seconded by Evelyn Jones to accept the new Lease Agreement with option to purchase and the Amended Commercial Lease Agreement, roll call-all yeses-James Soriano abstained, motion passes

Kathryn Kerr made a motion seconded by Steven Hammond to remove the conflict of interest, and allow James Soriano to vote on all motions, roll call-Michelle Kundrat-no, James Soriano-abstain, Evelyn Jones-yes, Kathryn Kerr-yes, Steven Hammond-yes, motion passes

Evelyn Jones made a motion seconded by Michelle Kundrat to make Kathryn Kerr the new Code Enforcer for $500 annually, roll call-all yeses, motion passes

Kathleen Tucker spoke to Council about renting Central Park for a Harvest Festival

Kathryn Kerr made a motion seconded by Evelyn Jones to allow Kathleen Tucker to rent Central Park for $150.00 the last weekend in October for a Harvest Festival, the bathrooms will be left open, to be locked at night by Kathleen, roll call-all yesses, motion passes

Melissa Lazzaro will contact the Fork Township Assessor to get more information on the taxes

Council discussed options for a phone for Tom, it was decided Straight Talk was the best option, Tom is using petty cash to purchase phone and minutes

Neither applicant for the DPW position was present, a Labor Board Meeting was scheduled for Friday July 15, 2022 at 1:00 pm

Council discussed and passed on the quote from Reith Riley

James Soriano made a motion seconded by Kathryn Kerr to renew Vivid Farms LLC Class B license, roll call-all yeses, motion passes

Committees: Parks and Recreation-Kathryn Kerr will be attending the next Fork Township Meeting to see if any Township Board Members would like to work with the Village on the new Parks and Recreation plan

Evelyn Jones made a motion seconded by Michelle Kundrat to purchase no parking signs, and poles, not to exceed $240.00, roll call-all yesses, motion passes
