Procedures for Village Rentals/Pavilion/Hall

Procedure for Reserving Village Pavilion:
The Village Rentals shall be available to all Renters on a first come, first serve basis. Reservations are made by completing the Rental Agreement and attachments, executed by the Renter, along with the payment of all required fees and deposits. (Mail or hand- deliver, (during office hours, or Drop Box, provided by the Village), application and fees to the Village of Barryton, to the attention of the Village Clerk, at the above address.
Refund upon Cancellation:
A full refund of both Rental Fee and Security Deposit shall be made for cancellations received at least fourteen (14) days prior to the date of rental. A full refund of the Security Deposit only, shall be made for cancellations received less than fourteen (14) days prior to the date of rental. If there is a cancellation less than 72 hours before the scheduled date, there will be no refund of fee or deposit. The purpose of the deposit is to secure the date and cover any potential damage to the grounds, whereas the rental fee pays for use of the site.
Security Deposit / Save the Date:
The damage/security deposit shall be used to Save the Date, as well as, repair, replace, or pay for any damage or loss to the Pavilion, grounds, or furnishings which are damaged or destroyed by the Renter or any party participant at the event. The Village of Barryton may hold such deposit for such a period of time as is necessary to determine the full extent of damages and to make all repairs and/or secure replacements.
The damages/security deposit or portion thereof, may be retained by the Village to cover excessive or unusual cleanup costs, to compensate for the use of Village Pavilion space, or for property usage after the contract period has expired.
*The Village personnel must approve the clean-up, repair or replacement before the refund can be made, then only after ten (10) days of the date of the rental.
Clean-up:
All leftover food, garbage, decorations, etc., must be put in barrels provided for this purpose.
Decorations:
Only thumbtacks may be used to affix any decorations. All decorations must be removed by the end of the rental period.
Indemnity:
Each Renter shall, in the written agreement, agree to indemnify and hold harmless the Village of Barryton, its officials, agents, and employees from and against any and all liability arising out of the Renter’s use of Village Property.
Damages:
Each Renter shall in the written agreement, agree to reimburse the Village of Barryton for all costs which may be incurred by the Village of Barryton in excess of the damage/security deposit for repair, replacement, or payment for any property of Village Property Rentals/Hall damaged or destroyed by the Renter or any participant at the Renter’s event. If damages to the facility have occurred, or conditions of clean-up have been violated, the deposit will be forfeited. If the cost is estimated to exceed the deposit amount, the Renter must present the Village with a cashier’s check or money order.

The undersigned Renter hereby agrees to rent the Pavilion/Hall and grounds owned by the Village of Barryton (the “Village”) and known as “Village Pavilion”. This agreement and any and all fees and deposits as required, are hereby tendered upon approval of application and upon submission of this Rental Agreement to the Village, Renter agrees to the following.

Renter represents and certifies that:
- All information provided in this application is true and correct.
- Misrepresentation or erroneous information in this application constitutes grounds for denial of future applications and use.
- Renter shall not use the premises for any unlawful or illegal purposes.
- Renter is at least 18 years of age for this application to be considered.
- Renter agrees to use care and diligence in the use of the premises. Rental will bear all cost of clean-up and damage; failure will result in loss of deposit and possible further charges incurred by the Village. _____________ (initials)

The Village of Barryton hereby sets forth the following fee schedules for rental and use of village property:
M-66 Park Pavilions: $50 per day/pavilion +$50 Deposit per day
East River Park: $30 +$50 Deposit per day
Farmer’s Market Pavilion $50+$50 Deposit per day
Central Park or Lion’s Park Gazebo: $25 +$25 Deposit per day
Central Park Festival use: $250 per day plus $500 deposit
Cancelation Policy: Must cancel or reschedule 72 hours before scheduled date or there will be no refund of fee or deposit
