Regular Meeting Minutes
President James Soriano called the Village Council to order at 6:00pm
Pledge to the flag was recited
Roll call: Evelyn Jones-present, James Soriano-present, Kathryn Kerr-present, Michelle Kundrat-present, Steven Hammond-present
Public Comment: A resident asked about the plowing issue from last month by the dentist office and if it had been resolved, the same resident also brought up the issue on Facebook claiming the Village is responsible for cleaning the sidewalk in front of the school, the school has always cleaned that sidewalk, and they will continue to do so, a resident claims a local business is pushing snow onto Haddix Blvd and leaving it in the road, Tom will address this, a resident expressed concern about all the stray cats in town
Barryton Police Report: Chief Morgan was absent
DPW Report: Tom Brown read the report, Tom is requesting a new discharge shoot for the lawn mower at a cost of $117.02, the old one has a hole in it from a rock, a light for the Farmers Market Pavilion at a cost of $19.99, not much going on right now, plowing is going well, residents have not been parking in the streets, a resident put up a shed without getting a permit, Tom has spoken with this resident several times asking him to fill out the permit application, it will be turned over to Chief Morgan, Tom presented Council with a new wastewater contract for 2022 with Gosling and Czubak
Kathryn Kerr made a motion seconded by Evelyn Jones to accept the new 2022 Wastewater Contract with Gosling and Czubak for $7,500, roll call-all yeses, motion passes
Evelyn Jones made a motion seconded by Michelle Kundrat to purchase a light for the Farmers Market Pavilion, not to exceed $20.00, roll call-all yeses, motion passes
Evelyn Jones made a motion seconded by Steven Hammond to purchase 6 quarts of motor oil, not to exceed $30.00, roll call-all yeses, motion passes
Minutes of Regular Meeting December 8, 2021, were presented

James Soriano read the President Report-nothing to report this month
Melissa Lazzaro read the Clerk’s Report, ARPA Reporting portal is now open, I need to report in April, Melissa’s surgery is scheduled for February 10, 2022 she will be off for 2-4 weeks, all the ordinances have been put together, the ordinances amended in 2015 are not signed, Melissa will compile a list and bring it to Council, Council needs to add Mindy Campbell to the Village Bank accounts, Melissa is requesting file folders from Quill for $12.99
Evelyn Jones made a motion seconded by Michelle Kundrat to purchase file folders from Quill not to exceed $12.99, roll call-all yeses, motion passes
Michelle Kundrat made a motion seconded by Kathryn Kerr to allow Isabella Bank to give information on Village account balances, and specific checks/transactions to Mindy Campbell and Melissa Lazzaro, to allow them make transfers between Village accounts, and to remove Courtney Garchow from all Village Accounts, roll call-all yeses, motion passes
Kathryn Kerr made a motion seconded by Evelyn Jones to accept the Clerks Report, all ayes, motion passes
Mindy Campbell read the Treasurer’s Report: Bank Balances as of 12/31/2021 per Isabella Bank Statement: General Fund: $144,376.96, Sewer Fund: $291,517.00, Solid Waste Fund: $38,918.25 Major Streets Fund: $108,499.76 Local Streets Fund: $44,623.75 Motor Pool Fund: $33,539.66 Sewer Bond Interest $1,018.81.
Office and DPW petty cash has been rectified, all coupons from the Farmers Market have been reimbursed for a total of $561.00, December 941 payment of $ 2,346.23 was made, the CD for the sewer Bond Reserve Account did an automatic renewal, the new maturity date is 7/2/2022, payments received this month include Revenue Sharing, Act 51, and restitution for a total of $11,276.46

Evelyn Jones made a motion seconded by Kathryn Kerr to pay General Fund bills with check #18900-18901 for $12,497.13 Sewer Fund with check # 3326-3339 for $14,754.37, Motor Pool fund with check #1367-1377 for $4,653.08, Solid Waste Fund with check #788 for $5,033.19, Major Street fund with check # 1090-1095 for $1,409.81 and Local Street fund with check #1024-1028 for $1,799.96 for a total of $40,147.54 with $13,202.58 for due to’s, roll call-all yeses, motion passes
The Village received no correspondence
Council has decided to wait on annexing land into the Village until there is more information about the solar panels
The Village has not received a land sale proposal from the Village attorney yet, Council asked Melissa to contact Mr. Williams to see how it’s coming along
Council is waiting on a drawing from Vivid Farms LLC showing the proposed placement of their sign.
Kathryn Kerr will continue to get information on bringing Solar panels to the Village
The Village is still in the process of looking for a Salvage Inspector
Council would like Melissa to send a letter to the Fork Township Board to ask about the water contract after the building is sold
Kathryn Kerr made a motion seconded by Steven Hammond to accept Labor Boards Recommendation to put the Treasurer on Probation, re-evaluate in 60 days, roll call-Michelle Kundrat-no, Evelyn Jones-no, Kathryn Kerr-yes, Steven Hammond-yes, James Soriano-no, motion fails
Evelyn Jones made a motion seconded by Michelle Kundrat to put the Treasurer on probation, re-evaluate in 90 days, roll call-all ayes, motion passes
Kathryn Kerr made a motion seconded by Evelyn Jones to accept the survey by Thomas Sage for Vivid Farms LLC, the property measures 295.17×295.17×295.17×295.17, roll call-all yeses, motion passes
Kathryn Kerr informed Council there is a resident interested in selling their property to the cannabis industry and would like Council to consider changing the current zoning to allow grows in A-1.
Michelle Kundrat sent an email to the Village on1/5/2022 resigning from her position of Trustee and all committees, Michelle sent an email on 1/7/2022 rescinding her resignation, but wished to remain off all committees, James Soriano expressed his concern about Michelle not being on committees, as that is part of her duty as a trustee, especially with the Audit Committee, Michelle stated she will be gone from February 3-21st and when she returns she will also return to the audit committee
James Soriano read the proposed changes to the Council Compensation Ordinance, a Public Hearing will be scheduled for February 28, 2022
Committees: Still looking for a Market Master for the Farmer’s Market
Public Comment: A resident asked if it was possible to get more than $6.25 a month for restitution from Chad Lindsey, Evelyn will call the Prosecutor’s Office, a resident brought up something mentioned on Facebook, Tom did plow the end of some driveways on Coolidge Ave because the mail carrier asked him to so she could get better access to the mailboxes
Council Comment: Kathryn Kerr updated Council on the new slide, its current delivery date is now January 20, Evelyn Jones asked if Courtney Garchow would be holding office hours while covering for Melissa Lazzaro, Courtney will not be holding office hours, it was discussed when Melissa asked Council to approve Courtney filling in, Melissa will notify the public the office will be closed on Mondays while she is gone. Evelyn Jones asked James Soriano if the night of the Workshop could be changed, Council agreed on Tuesday for January, after that it will be on the 2nd Wednesday at 5:00pm
Michelle Kundrat made a motion seconded by Evelyn Jones to require the Clerk and Treasurer to attend the monthly workshop, roll call-Michelle Kundrat-yes, Steven Hammond-no, Evelyn Jones-yes, James Soriano-no, Kathryn Kerr-yes, motion passes
James Soriano made a motion seconded by Kathryn Kerr to pay the Clerk and Treasurer $50 each to attend the monthly workshop, to be paid meeting week, only if attended, roll call-all yeses, motion passes
