Regular Meeting Minutes
President Daniel Cross called the Village Council to order at 6:00pm
Pledge to the flag was recited
Roll call: Daniel Cross-present, Kathryn Kerr-present, Michelle Kundrat-present, Terah Eaton-present, Amy MacKersie-present
Public Comment: Dan wanted to let everyone know that he wears a hearing aid, and it’s a disability, he is waiting to get a cochlear implant, but it had to be put off due to his shoulder surgery. He has a hard time hearing when everyone is talking at once and is asking that people please speak one at a time. He is not going to be wearing his hearing aid because it gets too distorted. If you have a comment, please raise your hand. A resident pointed out that Kathryn’s appointment to Pro Tempore was not voted on by council. A resident asked when the corner by Murphy’s Pizza & Subs is going to be fixed-will be covered in New Business, another resident asked when bids were going to start for the dam, that should be next week.
Daniel Cross made a motion seconded by Amy MacKersie to have Kathryn Kerr remain Pro Tempore until December 1st, 2026, roll call-Daniel Cross-yes, Terah Eaton-yes, Amy MacKersie-yes, Michelle Kundrat-no, Kathryn Kerr-abstain, motion passes
County Commissioner Greg Adams gave a report on County happenings-they are working on putting the Tonkin Drain to rest as the County Commissioners have no jurisdiction over the Drain Commissioner. They are currently working on legislation to have more control over the Drain Commissioner, Sheriff’s department bought a new boat, remodeling the Court House and working on the new EMS Building
Barryton Police Report: Chief Morgan was absent
DPW Report: Jake needs 2 springs for the V plow, $65.00 at the Ina Store, the cylinder on the V plow is leaking and needs to be rebuilt
Amy MacKersie made a motion seconded by Michelle Kundrat to purchase 2 springs at the Ina Store, not to exceed $150 roll call-all yeses, motion passes
Kathryn Kerr made a motion seconded by Michelle Kundrat to have the V plow cylinder rebuilt, for less than $460, roll call-all yeses, motion passes
Michelle Kundrat made a motion seconded by Kathryn Kerr to purchase a shop vac at Home Depot, not to exceed $120, roll call-all yeses, motion passes
Amy MacKersie made a motion seconded by Kathryn Kerr to turn on the power at the Coolidge Ave Building, roll call-all yeses, motion passes
Minutes of Regular Meeting August 12, 2026, and Public Hearing August 12, 2026, were presented
Kathryn Kerr made a motion seconded by Michelle Kundrat to accept all minutes as written, roll call-all ayes, motion passes
Daniel Cross read the President Report: Dan has a drain by his house with the same issue as the one on Northern Ave, Jake reported that there are several like that in the village, however Northern Ave is the worst one and needs to be fixed first
Lisa Rodgers was absent, Michelle Kundrat read the Treasurers report: Bank balances as of 8/31/ 2026, General Fund-$539,043.18, Sewer Fund-$317,810.65, Solid Waste Fund-$32,109.43, Major Streets-$66,163.67, Local Streets-$36,721.92, Motor Pool-$50,285.76
CD balances: Sewer Reserve (53,535.61)
General (50,000), Solid (10,000), Major (15,000), Local (25,000), Motor Pool (20,000) = $120,000
Accumulated Interest (Matures 11/10/2026): $3,571.44
Tax Day is soon, at the end of the month taxes will be submitted to the County. We should receive county funds by November and will need to review the budget at that time.
Michelle Kundrat made a motion seconded by Kathryn Kerr to pay July 10, 2026-August 13, 2026 bills, General Fund bills with check #20151-20169 721-735(E) for $48,741.03 Sewer Fund with check #3542-3544 3170-3174 (E) for $1,096,991.45, Motor Pool fund with check #58-59(E) for $480.96, Solid Waste Fund with check #784-785 (E) for $1,165.02, Local Street with check #1079 42-43 (E) for $3,383.46 and Major Street Fund with check #49-51 (E) for $2,305.82 for a total of $1,153,067.74, roll call-all yeses, motion passes
Anna Smith sent an email to the village with several resources for people in the village, Kathryn will post on the village website. She also set information on several grants the village can apply for.
Amy MacKersie made a motion seconded by Kathryn Kerr to put the amended sewer ordinance in the Pioneer, for a public hearing scheduled for October 14, 2026, at 5:45, roll call-all yeses, motion passes
Michelle Kundrat made a motion seconded by Terah Eaton to have Melissa Lazzaro be the administrator for the BS&A software, roll call-all yeses, motion passes
Will have a meeting before the Farmer’s Markert and Flea Market start next year to come up with a contract for the 2027 season.
Waiting on an answer from MDOT about the maintenance of the signal for the Safe Route to School Grant
Amy MacKersie made a motion seconded by Michelle Kundrat to sell the property the American Legion is on to the American Legion for $995, contingent upon them paying for the survey, attorney fees, and all other costs associated with the sale of the property, all yeses, motion passes
Amy MacKersie made a motion seconded by Michelle Kundrat to send the proposed Data Center Ordinance to the village attorney, roll call-all yesses, motion passes
Kathryn Kerr made a motion seconded by Amy MacKersie to renew the Labor Law Poster subscription for $49/yr., roll call-all yeses, motion passes
Kathryn Kerr made a motion seconded by Michelle Kundrat to accept the bid from Isabella Corporation for $14,900 to fix the sink hole on Northern Ave, roll call-all yeses, motion passes
Remove Michelle Kundrat from Audit Committee and add Amy MacKersie
Kathryn Kerr made a motion seconded by Michelle Kundrat to allow Derrick Waldfogel to park his semi-truck in Central Park on the weekends needed for $25/night with a village approved parking permit and a signed hold harmless agreement, for 6 months, roll call-Michelle Kundrat-yes, Dan Cross-yes, Amy MacKersie-no, Kathryn Kerr-yes, Terah Eaton-no, motion passes
The homeowner at 301 Angel asked the village to put up an L-shaped fence around the lift station on the corner because they say they are having a hard time selling the home because of it. They are welcome to put one there, however, the village will not.

Michelle Kundrat made a motion seconded by Kathryn Kerr to extend the meeting 10 minutes, roll call-all ayes, motion passes

Council Comment: Michelle asked Kat to please make the ordinance spread sheet like she used to. Terah asked if Council members could take care of refill issues at the park instead of calling Jake out, Melissa stated she will pass out candy and hot cocoa on Halloween again, and donations from council would be appreciated
